Family Law Property Valuations

PWE Property Consultants & Valuers provides independent property valuations across the Perth metropolitan area for separating couples, family lawyers and mediators. Every report is prepared by a licensed valuer with over 20 years’ experience.

Why a valuation is needed

Before property can be divided after a separation, the assets have to be identified and valued. Real estate is usually the largest of them. An independent valuation gives both parties a figure neither of them produced, which is often what allows a settlement to be reached without going to a hearing.

In Western Australia, property matters for both married and de facto couples are dealt with by the Family Court of Western Australia.

How we are instructed

  • Jointly, by both parties. This is the most common arrangement. The court’s rules provide for a single expert witness appointed by agreement between the parties, and one jointly instructed valuer usually costs less and carries more weight than two competing reports.
  • By one party. For your own information before negotiating or attending mediation, so you know where the value is likely to sit.

However we are instructed, the valuer’s duty is to give an independent opinion. We do not act as an advocate for either side.

What we value

  • The family home
  • Investment houses, units and vacant land
  • Commercial and industrial property held personally or through a company, trust or self-managed super fund
  • Property as at today’s date, and as at an earlier date where the parties require it

Why choose PWE?

PWE is an independent Perth valuation practice whose three directors are all licensed valuers, each with more than 20 years’ experience across residential, commercial and industrial property. We take instructions directly from the parties or their solicitors, and the contents of a report are released only to the people who instructed it.

Where a transfer between the parties follows, we also provide stamp duty valuations and capital gains tax valuations.

Frequently asked questions

Who pays for the valuation?

Where the valuer is jointly instructed, the fee is usually shared equally unless the parties agree otherwise.

Do we need to be in court to get a valuation?

No. Most of our family law valuations are used in negotiation, mediation or consent orders and never go near a hearing.

Can I get my own valuation as well?

You can for your own guidance. If the matter goes to court, the rules limit the expert evidence each party can put forward, so speak to your lawyer first.

What if one of us disagrees with the figure?

Questions can be put to the valuer in writing, normally through your lawyers, and the valuer will respond to both parties.

Do we both need to be at the inspection?

No. We only need access to the property. Either party, or neither, may attend.

Which areas do you cover?

We value property throughout the Perth metropolitan area.
